Significant change of Labour Code regarding transparency of remuneration

On 18 June, Polish President signed the Act of 4 June 2025 amending the Labour Code.

The aim of the amendments is to oblige employers to reveal the proposed remuneration in job advertisements. The changes are supposed to increase transparency of remuneration, promote equality, counteract discrimination during the recruitment process, and protect candidates’ privacy.

The employer will be obliged to inform the candidate about the proposed remuneration (including its components, amount or brackets) established based on objective and equality criteria and, if applicable, about the relevant provisions of a collective labour agreement or remuneration regulations.

The employer will have to inform the candidate about the remuneration in good time, in paper or electronic form, be it in the job advertisement, before the job interview, or prior to the employment itself.

In addition, job advertisements and recruitment process should be gender neutral and non-discriminatory. Questions about candidate’s prior remuneration will be banned.

The amended Labour Code will come into force 6 months from the day of its announcement, meaning most probably near the end of this year.
