Protection of employees against discrimination and mobbing – President signed amendment to Labour Code

On 30 July 2026, the President of Poland signed an amendment to the Labour Code and Civil Procedure Code in the part relating to the protection of employees against mobbing, discrimination, and slander.

The amended provisions aim at better employee protection against mobbing, discrimination, violating dignity and other personal rights, especially through:

  • simplifying and clarifying legal definitions,
  • making it easier to claim damages,
  • increasing the amount of minimal compensation,
  • introducing the so-called rational victim model, and
  • vesting employer with concrete obligations in the scope of counteracting these problems.

For example, employers employing 10 or more employees will have to adopt separate regulations on counteracting mobbing and discrimination.

The Amendment to the Code of Civil Procedure aims at improving the process of examining cases regarding mobbing, discrimination and slander towards employees. The changes relate to competence of courts and juries issuing decisions in the scope of these kinds of cases.

The Amendment enters into force 3 months after its announcement in the Journal of Laws. Employers will have 6 months from then to prepare and implement the required regulations and procedures.
